DMCA Takedown Policy

  1. Introduction: This policy outlines the process for reporting alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). Black Talk Radio Network respects the intellectual property rights of others and expects its users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, you may notify our copyright agent as set forth in the DMCA.
  2. Procedure for Reporting Copyright Infringements: If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our copyright agent with the following information:

    • Repeat infringers’ accounts may be terminated in accordance with Black Talk Radio Network’s repeat infringer policy.
  5. Counter-Notification: If you believe that the material has been removed by mistake or misidentification, you may send a counter-notification to our copyright agent containing the following information:
    • Your physical or electronic signature.
    • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
    • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
    • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Black Talk Radio Network may be found, and that you will accept service of process from the person who provided the original complaint.

    Upon receipt of a valid counter-notification, Black Talk Radio Network will restore the material in question, unless the copyright owner files a court action against the user alleging infringement and provides notice of that action.
